TERMS AND CONDITIONS

This website (“Site”) is operated by Qoosales.com located at 151 Chin Swee Road #03 – 33, Manhattan House, Singapore 169876. Accessing this Site constitutes your agreement to the following Terms and Conditions (“Terms”). If you do not agree with these Terms, you may not access the Site.

We reserve the right to revise these Terms and Conditions at any time. As such, you should check these Terms and Conditions periodically. Changes will not apply to any orders we have already accepted unless the law requires otherwise. If you violate any of the terms of these Terms and Conditions, you will have your access cancelled and you may be permanently banned from accessing the Site. If you access the Site after we have posted changes to these Terms and Conditions, such access shall constitute your acceptance of those changes, whether or not you actually reviewed them. At the bottom of this page, we will notify you of the date these Terms were last updated.

PRIVACY

Please review our Privacy Policy, which also governs your use of Qoosales.com.

CHILDREN

No Products are for sale to children and any children's Products are displayed for purchase by adults. If you are under 18 you may use Qoosales.com only with the involvement of a parent or guardian.

PROPER USE OF QOOSALES.COM

Use of qoosales.com is limited to parties that can lawfully enter into and form contracts under the laws of Singapore.

You may not misuse Qoosales.com.

You may use Qoosales.com only as permitted by applicable Regulations.

You must not use Qoosales.com: (i) in any way that causes, or is likely to cause, Qoosales.com, or any access to it, to be interrupted, damaged or impaired in any way; (ii) for fraudulent purposes, or in connection with a criminal offence or other unlawful activity; or (iii) to cause annoyance, inconvenience or anxiety.

The licences granted by Qoosales.com under these Conditions terminate if you do not comply with these Conditions and any other Applicable Terms. We reserve the right to refuse service, terminate accounts or remove or edit content if you are in breach of applicable Regulations, these Conditions or any other Applicable Terms.

QOOSALES.COM SELLS DIRECT

Qoosales.com sells Products directly to customers. We do not have any third party sellers using this Site.

COPYRIGHT

The Brand Names and all content included in or made available on Qoosales.com, such as text, graphics, trademarks, logos, button icons, images, audio clips, digital downloads and data compilations is the property of Qoosales.com (or its content suppliers). The compilation of all content included in or made available through Qoosales.com is the exclusive property of Qoosales.com.

You may not extract and/or re-use the Brand Names or parts of the content of Qoosales.com without our express written consent. In particular, you may not use any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-use of any substantial parts of the content of Qoosales.com, without our express written consent. You may also not create and/or publish your own database that features substantial parts of Qoosales.com (e.g. prices and product listings) without our expressed written consent.

LIMITATION OF QOOSALES.COM'S LIABILITY

We will do our utmost to ensure that availability of Qoosales.com will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed. Also, your access to any part of Qoosales.com may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

Qoosales.com will not be responsible for: (i) losses that were not caused by any breach on our part; or (iii) any indirect or consequential losses that were not foreseeable to both you and us when you commenced using Qoosales.com. Nothing in these Conditions shall limit or exclude any liability for fraud or any other liability that cannot be lawfully limited and excluded.

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your legal right to have goods sent or services provided within a reasonable time or to receive a refund if goods or services ordered cannot be supplied within a reasonable time owing to a cause beyond our reasonable control.

HOW TO PLACE AN ORDER

You can either place an order as a guest or by creating an account. After placing an order, you will receive an email from us acknowledging that we have received your order (“Order Confirmation”). Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email confirming the shipment of your order (the “Shipping Confirmation”). A contract with us will only be formed when we send you the Shipping Confirmation. The contract will relate only to those products whose shipment we have confirmed in the Shipping Confirmation. We reserve the right to cancel your order at any time before we have accepted it and we may rescind our acceptance and cancel your order where there has been an obvious error in price or where the product is no longer in our inventory.

PRICES, AVAILABILITY AND ERRORS

Products on our Site are subject to change without notice. Despite our best efforts, products listed on our Site may be incorrectly priced, the quantity or availability of a product may have changed just prior to you placing your order or other errors may be displayed on the product page. In the event of error, we will normally, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of such rejection. We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you an Order Confirmation or a Shipping Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a pricing error. If we reject your Order you will receive a refund of any money paid.

COLLECTION OF TAX

For purchases where sales tax is applicable you will see the tax calculated on the checkout page before you are asked to confirm the purchase. Tax shown at checkout is an estimate and the actual tax collected may differ once we process the order. We use reasonable commercial efforts to calculate and remit the correct amount of tax required on each taxable purchase, but we do not guarantee the accuracy of the amount of the tax we represent to you. Minor errors may occur owing to the inability to accurately track multiple taxing districts, state and local “tax holidays,” the timing of rate changes or the application of certain taxes to categories of items we sell. As a result of any error, we may overcollect or undercollect your tax. In consideration of our allowing you access to and use of the Site, and in collecting and remitting taxes required on your purchases, you hereby waive your right to claim that the tax collected on any purchase is incorrect in any respect and agree to hold us harmless, our officers, directors, employees, agents and representatives, for any harm or other damages you may incur as a result of our error in calculating the taxes you owe for your purchases.

SHIPPING

The term shipping or ship includes the commencement of shipping items in an order for multiple purchases or where the item purchased consists of components that must be shipped separately. For example, your order may consist of (1) several different items, (2) a quantity of the same item, or, (3) a single item with several component parts the size of which might require them to be shipped in separate packages. In all such orders, we endeavor to ship out individual packages together so that they arrive at the same time; however, when that is not possible, we commence shipping by shipping individual packages in the order the soonest they are available and conditions permit. In these instances, our notification to you that your order has “shipped,” marks the time when shipping has commenced; it does not mean that all items in the order have shipped at that time. All packages sent have a separate tracking number and may be followed on the Order Status page. We reserve the right to redirect your shipment at any time prior to delivery, should we deem it necessary. You agree that credit cards and debit cards are to be charged on the date of inventory reservation for the order, not the date of shipping.

INTERNATIONAL RETURNS

You can initiate a return for most new and unopened items within 30 days of delivery for a full refund. You must return items in new or unused condition with all original materials included with the shipment. We must receive your returned items at our processing facility within 45 days of delivery. We inspect all returned items and award a partial refund for opened or used products. If the return is a result of our error or defective product, we will refund the full cost of the merchandise and shipping charges.

If you initiate a return after 30 days, Qoosales.com may issue a partial refund depending on elapsed time and condition of merchandise.

QOOSALES’S PROCEDURES FOR INTERNATIONAL REFUNDS

We thoroughly inspect all items when they arrive at our returns facility. We will refund the full cost of the merchandise and all original shipping charges if your return is a result of our error or a defective product.

If the return is not a result of our error, we will refund the full cost of the merchandise minus the original shipping charge, insurance, and return shipping fees.

If you return an item that was opened or shows signs of wear, we may issue a partial refund. Products decrease in value over time; therefore, we reduce refunds for returns initiated over 30 days after delivery or received at our returns facility after 45 days.

You will receive a refund processed at the exchange rate effective at the time of purchase, including any customs, tariffs, and taxes on the order. We will issue your refund to the form of payment within 5 - 7 business days after the package arrives at our facility.

Once we issue your credit, we send you an email with your refund details. Depending on your bank or credit card company, it may take up to 5 additional business days for processing. If you have any questions or concerns about credit posting, please contact your financial institution.

EXCEPTIONS TO THE INTERNATIONAL RETURN POLICY?

Non-Returnable Items

Any item specifically marked as Non-Returnable on the product page will not be accepted for returns.

PRODUCTS RETURNED AFTER 30 DAYS

Because products decrease in value over time, we offer partial refunds for items returned more than 30 days after delivery. In addition, we may reduce the refund further based on the condition of the merchandise. We also deduct the original and return shipping charges from your refund, as described in the Returns Policy.

DEFECTIVE PRODUCT AND RETURNS DUE TO OUR ERROR

Defective items, items damaged at the time of receipt, and incorrect items received may be returned without penalty. Your shipping charges will be waived. When we receive your return, we will inspect the item and issue you a refund. If the product is not found to be defective, shipping fees will apply and/or a partial refund may be issued.

CAN I GET AN EXCHANGE, OR REPLACEMENT?

At this time, we are unable to process exchanges or replacements for international orders. If you wish to make an exchange or need a replacement, you must return the original item back to us and place a new order for a replacement item. For assistance, please click here to contact us.

HOW DO I RETURN MY INTERNATIONAL ORDER?

To initiate a return on an international order, you must contact us within 30 days from the date your package arrives at your doorstep to create a Return Authorization.

Upon contacting us, we will provide you with a Commercial Invoice and further return instructions.

Print out the documentation provided (Commercial Invoice and/or Return Label). Place all items being returned in one parcel.

Attach the commercial invoice in a plastic document sleeve on the outside of our return package. This is necessary for your return to clear customs.

Follow any additional instructions provided via email along with the return shipping address.

GOVERNING LAW

These terms and conditions shall be governed by the law of Singapore. Both we and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Singapore.
